Keeping You Current on Proposed Rule 151A by the SEC

On Wednesday, June 25th 2008 the Securities and Exchange Commission (SEC) proposed a rule (Rule 151A) that would change the securities status of Indexed Annuities from fixed insurance products to registered, securities products. The SEC proposes that indexed annuities are no longer annuities according to their definition, and thereby subject to federal regulation. The initial formal comment period on Rule 151A ended September 10th, 2008. It was then reopened from October 10th to November 10th, 2008. During that time, interested parties had the opportunity to comment to the SEC on their own position on the matter. In total 4,448 comments were submitted on the matter as of December 12, 2008- the majority of which opposed the proposed rule.

The SEC held an Open Meeting to discuss the aforementioned matter on December 17th, 2008 after the second formal comment period ended. Proposed rule 151A was adopted with minor modifications in a 4 – 1 vote at that time. Rule 151A will only apply to indexed annuities that are issued after the Rule’s effective date, which will be January 12, 2011.

Rest assured that several of the carriers that we work with have already assured us that they will be taking legal action against the SEC to challenge this rule. We will continue to work with every carrier and marketing organization in the industry, to ensure that indexed annuities remain fixed products in spite of the SEC’s decision. In addition, we will work with our partners, to ensure indexed annuity product development that falls outside of the SEC’s definition of a security.
